By downloading, installing, or using this application ("App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not download, install, or use the App.
The App provides speech and language development tools for children and offers subscription-based services as described below.
The App offers the following subscription options for users in the United States:
Prices may vary in other countries or regions. All prices include applicable taxes unless otherwise stated.
All subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase. No refund will be provided for the unused portion of any subscription period that has already begun.
If offered, any free trial period will automatically convert to a paid subscription unless canceled at least 24 hours before the trial period ends. You cannot reactivate a free trial once it has been used and canceled.
You will be notified of any price changes and will have the opportunity to accept or decline the new price before being charged.

The App, including all content, features, and functionality, is owned by "PLAY TALK KIDS" and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
If the App allows you to submit content, you retain ownership of your content but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with the service provided by the App.
Your use of the App is also governed by our Privacy Policy, which can be found at https://playtalk.app/privacy-policy.html. By using the App, you consent to the terms of the Privacy Policy.
"PLAY TALK KIDS" is directed to children under the age of 13 and complies with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13 without verifiable parental consent. Before collecting any personal information from a child under 13, we will seek verifiable parental consent through one of the methods approved by the Federal Trade Commission.

You agree that "PLAY TALK KIDS" may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the App. "PLAY TALK KIDS" may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL "PLAY TALK KIDS" BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER ARISING OUT OF OR CONNECTED WITH THE USE OR INABILITY TO USE THE APP.
We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms of Use.
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms within the App and updating the "Last Updated" date. Your continued use of the App following such changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. In particular, but without limitation, the App may not be exported or re-exported (a) into any U.S. embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List.
You also agree that you will not use the App for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.
